1. Agreement to these Terms

By accessing or using the services, you agree to these Terms and our Privacy Policy. If you use the services for a business or organization, you represent that you are authorized to bind it. If you do not agree, do not use the services.

2. Eligibility and authorized use

You must be legally capable of entering an agreement and authorized to access the applicable BLD-Tech or customer workspace. The services are intended for BLD-Tech personnel, customers, and other approved users. Access is limited to information and functions assigned to your account.

3. Accounts and security

You are responsible for accurate account information, safeguarding credentials and devices, and promptly reporting suspected unauthorized access. You may not share credentials, bypass access controls, impersonate another person, or access records you are not authorized to use.

4. Acceptable use

You may not misuse the services, interfere with their operation, introduce malicious code, probe or circumvent security, scrape or copy data without authorization, use the services unlawfully, or upload content that infringes rights or contains unlawful material.

5. Customer and service content

Authorized users may submit customer information, tickets, messages, photographs, documents, signatures, equipment data, quotes, and related content. You represent that you have the right and any necessary consent to submit that content. You grant BLD-Tech permission to host, process, reproduce, and transmit it as needed to operate and support the services.

6. Quotes, services, and separate agreements

Information in the app or website is not a binding service commitment unless expressly stated. Quotes, statements of work, invoices, warranties, subscriptions, installation terms, or other service arrangements may have additional terms. If those terms conflict with these Terms, the more specific written agreement controls for that transaction.

7. Payments

The mobile app does not currently process payments. If payment features are added, additional payment terms and a third-party processor’s terms may apply. Charges will be disclosed before a transaction is authorized.

8. Third-party services

The services may rely on or link to third-party platforms, including authentication, hosting, notification, form-processing, and app-distribution providers. Their services are governed by their own terms and policies. BLD-Tech is not responsible for third-party services outside its control.

9. Intellectual property

The services, branding, software, designs, and original content are owned by BLD-Tech LLC or its licensors and are protected by applicable law. These Terms grant a limited, revocable, nonexclusive, nontransferable right to use the services for their intended purpose.

10. Availability and changes

We may maintain, modify, suspend, or discontinue features and may update these Terms. We do not guarantee uninterrupted or error-free availability. Continued use after updated Terms become effective constitutes acceptance of the revised Terms.

11. Termination

You may stop using the services at any time. BLD-Tech may restrict or terminate access for misuse, security risk, nonpayment under a separate agreement, legal requirements, or violation of these Terms. Provisions that by their nature should survive termination will remain effective.

12. Disclaimers

To the fullest extent permitted by law, the services are provided “as is” and “as available.” BLD-Tech disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. Nothing here excludes warranties that cannot legally be excluded.

13. Limitation of liability

To the fullest extent permitted by law, BLD-Tech LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from use of the services. Any direct liability will be limited to the amount paid for the applicable service during the twelve months preceding the claim, unless applicable law requires otherwise.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any dispute not subject to another written agreement will be brought in a court with jurisdiction serving Mercer County, Pennsylvania, unless applicable law requires another venue.
